Mediation is a process governed by certain principles that help parties & mediators identify and carry on an effective resolution to the dispute which led to the discussions. These principles ensure that a mediation is held to the favour of the parties so that the decisions made effectively solve disputes to their satisfaction and that they do not feel that they did not get a fair chance to present the case and had the case been something else the outcome could have been different. The very fact that mediation is a party driven process rids it of the lacunae of an unfair hearing. The principles are many, each of which lay the onus on either the party or the mediator or both of them to maintain the expectations and the standards that mediation has set for itself.
With the assistance of a neutral member who acts as a third party in the process (the mediator), tries to settle the issues by identifying the real issues and making the parties agree to a terms that end the conflict.
